変わった著作物①二次的著作物(Diverse copyrighted works①Derivative works)

著作物の中の変わり者を紹介します。今回は二次的著作物についてです。

二次的著作物

著作物に手を加えて新しく創作すると、「二次的著作物」になります。

二次的著作物　著作物を翻訳し、編曲し、若しくは変形し、又は脚色し、映画化し、その他翻案することにより創作した著作物をいう。（著作権法第二条十一）

1. 翻訳*：別の言語に表現しなおす（英語など）
2. 編曲：既存の音楽の著作物をアレンジする
3. 変形：絵を彫刻にしたり、写真を絵にしたりする
4. 翻案*：脚色、映画化など

１*：点字や暗号を日本語にするのは翻訳ではありません）

４*：プログラムのバージョンアップを含みます

もともとが著作物ではないものに創作を加えたら、それはオリジナルの著作物です。

この「二次的著作物を作る権利」も、もともとの著作権者が持っているので許可が必要です。無断で創作して公に出すと、翻訳権や翻案権の侵害となります。

この「二次的著作物」を使いたいときは、おおもとの著作権者にもさかのぼって許諾が必要です。手間が倍…。

小説や漫画が映画化されたりするときは、あらかじめこの権利関係も契約でしっかり固めてあります。

This article is about derivative works.

Derivative work

When a work is modified and re-created, it becomes a 'derivative work'.

A derivative work is a work created by translating, arranging, transforming, adapting, filming or otherwise adapting a work. (Article 2(11) of the Copyright Act)

1. Translation*: Re-expression in another language (e.g. English)
2. Arrangement: arranging an existing musical work
3. Transformation: e.g. turning a picture into a sculpture, a photograph into a painting
4. Adaptation*: adaptation, film adaptation, etc.

1*: converting Braille or code into Japanese is not translation)

4*: Includes version upgrading software

A creative work is an original work if you create it by using a work that was not originally copyrighted.

This 'right to make a derivative work' is also held by the original copyright holder and requires permission.So if you make a derivative work without permission and publish it, you are infringing the right of translation or adaptation.

You also need permission from the original copyright holder to use a 'derivative work'. Double the trouble...

Permission required: Original copyright holder + Derivative copyright holder

When a novel or cartoon is made into a film, the rights are also fixed in advance by contract.
