著作物の中の変わり者②編集著作物について。例えば、辞典や詩集、新聞、雑誌が該当します。
編集著作物
もともと「著作物」は表現であるので、単なるデータや事実は含みません。でもそれを集めたら…選び方・並べ方、に創作性が発生して、集合体そのものが著作物になります。
編集著作物 編集物（データベースに該当するものを除く。以下同じ。）でその素材の選択又は配列によつて創作性を有するものは、著作物として保護する。（著作権法第十二条1項）
使う素材が著作物かどうかは関係ありませんが、著作物だったら編集するときに素材の著作者に許可が必要です。
雑誌
読者が雑誌をコピーして営利で使いたいときは、雑誌社＋各素材の著作権者にOKもらわねばなりません。まあ編集するときに各素材の著作権は雑誌社が認識しているはずなので、聞いてみるとよいです。もしかしたら包括契約してるかもしれない（自分で素材権利者に確認してと言われることのほうが多そう）。
新聞記事
新聞記事をコピーしたい、スポーツ報道写真をチラシに使いたい、という時は、新聞社のカメラマンが撮っていれば新聞社に著作権（法人著作）があるものの、写ってる学生さん（学校）に確認してくださいと返事していました。新聞は時事の報道のために撮って載せられるけど、チラシに使うとなると学生さんの肖像権を考慮しないといけません。知らないうちに自分の顔がチラシに載ってたら学生さんが驚きます。
詩集
ある詩集があって素敵な作品Aを見つけて使いたいとき、これは作品Aの著作権者に許諾を取れば足ります。あくまで選択と配列に編集著作物の権利は発生するので、詩集それ自体の複製とは別と認識します。条文2項に書いてあります。
前項の規定は、同項の編集物の部分を構成する著作物の著作者の権利に影響を及ぼさない。（著作権法第十二条2項）
おまけ
編集著作物、というからには、創作性がなければいけません。時系列とか、ABC順とか、思いつくまま選んだ、だと、著作物と認められません。

Edited works
Originally, a 'work' is an expression, so it does not include mere data or facts. But if you collect them... creativity arises in the way they are selected and arranged, and the aggregate itself becomes a work.
Editorial works Editorial works (excluding those falling under databases. The same applies below). (Article 12 of the Copyright Act)... which has creativity in the selection or arrangement of its material shall be protected as a work. (Article 12(1) Copyright Act)
It does not matter whether the material used is a copyrighted work or not, but if it is a copyrighted work, permission must be obtained from the author of the material when editing it.
Magazines
If a reader wants to copy a magazine and use it for commercial purposes, they need to get permission from the magazine company and the copyright holder of each material.
Now, the magazine should be aware of the copyright of each material when it is published, so you can ask them.
Newspaper articles
When readers wanted to copy a newspaper article or use a sports photo for a flyer, I used to reply [Would you try to check with the person in the picture?]
Because newspapers can use it for news coverage, but if you want to use it on a flyer, you have to respect the students' image rights.
Poetry collections
If you wish to use work A in a collection of poems, it is sufficient to obtain permission from the author of work A. This is different from reproducing the entire collection of poems.
The provisions of the preceding paragraph shall not affect the rights of the author of the work forming part of the compilation referred to in that paragraph. (Article 12(2) of the Copyright Act)
Extra.
A compilation work must be creative. It cannot be recognised as a work if it is in chronological order, in ABC order or selected according to mood.
